Terms of Service & Sale
The agreement between you and Foodster when you order food from us — what we promise, what we ask of you, and what happens when something goes wrong.

1. Who you are dealing with
Foodster is operated by Foodster Retail Limited (RC 6912929), UL38 Palms Shopping Mall, Ring Road, Ibadan, Oyo State, Nigeria. In these terms “we” and “Foodster” mean that company, and “you” means the person using the site, the apps or one of our counters.
We sell our own food from our own kitchens. Foodster is not a marketplace acting between you and someone else, so where something is wrong with your order, it is ours to put right.
By placing an order you accept these terms, our Privacy Notice and our Orders, Cancellations & Refunds Policy. If you do not accept them, please do not order.
2. Your account
You must be at least 18 to hold an account. Keep your details accurate and your sign-in credentials to yourself — orders placed from your account are treated as yours unless you tell us it was not you. Tell us immediately if you think someone else has access.
You can close your account whenever you like: see Account & data deletion.
3. Menu, availability and prices
We cook ahead in limited quantities, so an item shown as available can sell out between your browsing it and your paying for it. Photographs are illustrative and portion sizes vary within normal ranges.
Prices are in Nigerian Naira and include VAT where it applies. Delivery and service charges, where any, are shown separately at checkout before you pay. We may change prices at any time, but never after we have accepted your order.
Errors happen. If an item is listed at an obviously wrong price and you could reasonably have recognised it as a mistake, we may cancel the order and refund you in full rather than fulfil it.
4. How an order is formed
Placing an order is an offer to buy, not a completed sale. The contract forms only when we confirm the order — you will see a confirmation in the app and receive a message. Until then we may decline it, for example if an item has sold out, the kitchen has closed, a payment cannot be verified, or the order looks fraudulent. If we decline after taking payment, we refund you in full.
5. Paying
You can pay by card, bank transfer or the other methods offered at checkout, through our payment provider, or with Foodster credit. Payment is taken when the order is placed, and card details are entered on the provider's own secure form — we never see or store your full card number.
Foodster credit
Foodster credit is a prepaid balance you can spend on Foodster. It is not a bank account and not electronic money: it earns no interest, cannot be transferred to another person, and can only be spent with us. Refunds may be returned to it where you ask us to. It does not expire while your account is open; if you close your account, tell us and we will return any remaining balance to your original payment method.
6. Pickup and delivery
Pickup. Choose a kitchen and a collection time. We prepare the food for that slot, so please arrive close to it. Food that goes uncollected is held safely for a reasonable period — usually to the end of that trading day — after which we may dispose of it, and we cannot refund a no-show.
Delivery, where we offer it, is fulfilled by us or by a delivery partner. Give a complete address and a number that will be answered. Times quoted are estimates, not guarantees: traffic, weather and demand move them. If nobody can receive the order after reasonable attempts to reach you, the rider may return it and we may not be able to refund it.
Risk in the food passes to you when you or someone at your address takes it. Please refrigerate or eat it promptly — see section 8.
7. Changing or cancelling
Food is prepared to order and perishable, so it is exempt from the usual change-of-mind cancellation right once preparation has begun. Before that point we will cancel and refund you in full. 8. Food safety, allergens and ingredients
Our kitchens handle nuts, peanuts, milk, eggs, gluten, soy, fish, shellfish and sesame. We take allergen handling seriously, but we cannot guarantee that any item is free from traces of an allergen prepared elsewhere in the same kitchen.
If you have a food allergy or intolerance, please tell us before you order — on WhatsApp, by phone on 0809 119 9001, or in the order notes — and we will tell you what we can and cannot serve you safely. Do not rely on a note alone, and do not rely on Oja AI: confirm it with a person.
Ingredient and nutrition information is given in good faith and may change as recipes and suppliers change. Once food leaves us, storing and reheating it safely is yours to manage: eat hot food promptly, and refrigerate anything you keep.
9. Age-restricted items
Where we sell alcohol or any other age-restricted item, you must be 18 or over to buy it, and we or the rider may ask for identification and refuse to hand it over without one. A refusal on this ground is not refundable for that item.
10. Using Foodster properly
You agree not to:
- place orders you do not intend to pay for or collect;
- use someone else's payment method or account, or give false details;
- abuse promotions, referral codes or credit — including by opening multiple accounts to claim an offer more than once;
- harass, threaten or abuse our staff, our riders or other customers;
- scrape, probe, overload or attempt to gain unauthorised access to our systems — conduct which may also be an offence under the Cybercrimes (Prohibition, Prevention, etc.) Act 2015; or
- resell our food commercially without our written agreement.
We may cancel orders, withdraw promotional credit, or suspend or close an account that breaches this section. Where we do, we will tell you why, and you can appeal by writing to us.
11. Reviews, ratings and messages
You keep ownership of what you write, and you give us a licence to display it on Foodster in connection with the item or order it concerns. Say what you honestly think — but do not post anything unlawful, defamatory, obscene, or containing someone else's personal details. We may remove content that breaches this, and we will not remove a review merely for being critical.
12. Oja AI
Oja AI helps you find items and assemble an order. It is automated, it can be wrong, and it does not create a contract: nothing it says overrides the menu, the price at checkout or the allergen guidance in section 8. Do not send it anything confidential. What it does with your messages is covered by the Privacy Notice.
13. Promotions, referrals and credit
Offers, discount codes, referral rewards and loyalty credit are subject to whatever terms are published with them, have no cash value unless we say so, and cannot be combined unless we say so. We may withdraw or change a promotion at any time, though never after you have relied on it for an order we have already accepted.
14. Events, tickets and subscriptions
Where we sell tickets to an event, or a recurring plan, the terms shown at the point of sale — including the cancellation and transfer rules for that specific event or plan — apply in addition to these terms and prevail if they conflict.
15. Our brand and content
The Foodster name, logo, photography, menus, site and app content belong to us or our licensors. You may use them to order from us; you may not copy, republish or use them commercially without our written permission.
16. If something goes wrong
We will provide our food and service with reasonable care and skill, and food that is safe, of satisfactory quality and as described. Where we fail, our responsibility is to put it right — a replacement, a refund, or both — as set out in the refunds policy.
Beyond that, we are not responsible for losses we could not reasonably have foreseen when you ordered, or for loss of profit or business opportunity. Except where a delay is our fault, we are not liable for one caused by events outside our reasonable control.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for unsafe food, or for anything else the law does not allow us to limit — including your rights under the Federal Competition and Consumer Protection Act 2018.
17. Changes to these terms
We may update these terms as the business changes. The version in force for your order is the one published when you placed it, and the date at the top of this page shows when we last changed anything. Material changes will be signposted before they take effect.
18. Complaints, law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction over any dispute. If a court finds any part of these terms unenforceable, the rest continues to apply.
